If you are considering a Divorce or have been served with a Summons and a Petition for Dissolution, you need a qualified and experienced Divorce Attorney. The outcome of your divorce, whether agreed to or ordered by the Court, will have an impact on your life.

Divorcing inside and outside of Court

There are several ways your divorce will be resolved. No matter which of the following ways it is resolved, your final dissolution of marriage must be approved by the Court.

  • UNCONTESTED DIVORCE: Your spouse and your self resolve all of the issues of equitable distribution, alimony, child support and custody, and all other matters. The only use of the Court is to accept the agreements and ensure that the statutory requirements of the divorce are met.
  • COLLABORATIVE DIVORCE: You and your spouse use a Divorce Attorney or preferably separate divorce attorneys to reach an amicable resolution. It is better for each spouse to have their own divorce attorney for many reasons, chief among them is that it makes it harder for one of the parties to say they were unduly influenced.
  • DIVORCE MEDIATION: This is after a petition for dissolution of marriage is filed and mandatory disclosure has taken place. In mediation a non involved Attorney acts as a third party facilitator in negotiations to help help the parties agree to a resolution.
  • CONTESTED DIVORCE: When issues can not be decided through agreement or mediation, the Court will hold a trial on the unresolved issues and will decide who gets what and for how long.
