Many Drug offenses require the judge to sentence the offender to a minimum mandatory sentence. These minimum mandatory sentences are determined by the type of drug and the quantity of the drug. Minimum Mandatory sentences are the lowest sentence a judge can lawfully impose without permission of the prosecutor. Only the prosecutor, or youthful offender departure, can waive the minimum mandatory and permit the offender be sentenced to less severe sanctions.
